1. Application
These terms and conditions apply when you use our websites, mobile applications, web shops, ticket shops, wireless (wifi, bluetooth) networks, software, membership and cashless payment cards and other online products and services ("Online Services").
By using our Online Services, you agree to these terms and conditions and agree to comply with and accept these terms and conditions. If you are a minor, you should read this agreement together with your parent(s) or guardian(s) and ask them to accept these terms and conditions.
2. Your Personal Account
You alone (and to the exclusion of KRC Genk) are responsible for maintaining the confidentiality and security of your personal account and for all activities that occur through your personal account. You may not disclose your personal account to any third party and its use is strictly personal. In the event of a breach of the security or confidentiality of your personal account, you must notify KRC Genk of the breach as quickly and accurately as possible. In no event shall KRC Genk be responsible for any unauthorized or unwanted use of your personal account by you or any third party.
3. Use of the Online Services
You undertake not to use the Online Services:
(a) for your own commercial purposes or for the commercial purposes of third parties. The use of the Online Services is limited to personal purposes only.
(b) to report, transmit, post, transmit, store or otherwise make available through the Online Services any unlawful, false, misleading, stolen, intentionally false, or other unlawful content or information;
(c) to submit, transmit, post, transmit or otherwise make available any content or information that is unlawful, offensive, threatening, racist, hateful, defamatory, defamatory, vulgar, obscene or harmful to KRC Genk and/or third parties (including other users);
(d) not to unduly or unlawfully burden, obstruct or otherwise interfere with the Online Services or related services, products, software, networking, access and other products and services.
4. Use of Your Data
By using our Online Services, such as (but not limited to) posting materials such as texts, photos and videos, you grant KRC Genk and its partners and suppliers the non-exclusive, worldwide, perpetual and free permission to (re)produce, distribute, publicly communicate, edit, delete, synchronize with other information and data, and otherwise use your information and data.
5. Third party information
The Online Services may contain information and data from third parties, such as information from sponsors, partners and suppliers and other users, including links and other references to third party websites, social media and other online services. However, KRC Genk does not control and is not obligated to control the content of the websites, social media and other online services of third parties, and in no event shall KRC Genk be liable or responsible for the content of the websites, social media and other online services of third parties. Furthermore, any reference to or inclusion of information and data of third parties does not imply that KRC Genk agrees with such content.
6. Intellectual Property
Our Online Services may contain information, data, images, works, data, texts, video material, databases, trademarks, trade names, domain names and other materials and data of KRC Genk and third parties, which are protected by (intellectual) (property) rights. You acknowledge these rights and you undertake not to use these materials and data in a manner that infringes the aforementioned rights of KRC Genk or third parties.
If you yourself send, post, publish, communicate or otherwise use information, data, images, works, text, video material and other materials and data on or through the Online Services, you undertake and warrant that you yourself have the necessary rights thereto, or have obtained permission to do so from the rightful claimant(s).
7. Privacy
The Online Services are subject to the privacy policy of KRC Genk. You can find our Privacy Policy on our website, in the same location as these Terms and Conditions.
8. Limitation of Liability
The Online Services (including all products and services provided through the Online Services) are always offered by KRC Genk 'as is'. KRC Genk only has a best-efforts obligation in this respect. The Online Services are used at one's own risk, without any guarantees or results being given by KRC Genk, either explicitly or implicitly. Only in jurisdictions where exclusion or limitation of a warranty cannot be invoked, that particular warranty shall not be excluded or limited and KRC Genk's warranty shall be excluded or limited to the minimum obligation imposed by applicable law.
KRC Genk cannot guarantee that the Online Services, in whole or in part, temporarily or permanently, will be without defects and cannot be held responsible or liable for any errors, defects, incompleteness, inaccuracies or other imperfections of the Online Services. KRC Genk cannot be obliged to repair any or all of the Online Services.
KRC Genk shall not be liable for any direct, indirect, incidental, punitive and/or consequential damages resulting from the use or inability to use the Online Services including all products and services provided through the Online Services. Only in jurisdictions where an exclusion or limitation of liability for consequential or incidental damages cannot be invoked, KRC Genk's liability shall be limited to the maximum exclusion permitted by law.
9. Termination of Online Services
KRC Genk has the right to suspend, remove, discontinue, limit or modify the Online Services in whole or in part with respect to one, more or all users at any time. KRC Genk may decide this without notice and without giving any reason. You may not hold KRC Genk liable or give KRC Genk notice of default for any such decision.
10. Termination of this Agreement
KRC Genk has the right to terminate this agreement at any time without notice and without giving any reason, including the right to close your personal account, without KRC Genk being liable in any way for any consequence resulting therefrom.
11. Changes
KRC Genk is entitled to unilaterally amend these general terms and conditions and contract at all times. For each new use of the Online Services, the latest version will apply. You should check this page regularly.
12. Miscellaneous provisions
Failure or delay by you or us in exercising any right under these terms and conditions will not be deemed a waiver of that right. Such failure or delay will not affect any other event or right.
If any provision of these terms and conditions should be or become invalid or unenforceable by any court of competent jurisdiction, such invalidity or unenforceability will not in any way affect the validity or enforceability of any other provision, in whole or in part.
No person who is not a party to these terms and conditions may thereby acquire any rights or enforce any provision of these terms and conditions, even if that person relies on such provision or has indicated to either party that it agrees to any provision of these terms and conditions.
A printed version of these Terms and Conditions, the Privacy Policy and the Online Terms and Conditions of Sale, and of any warning and notice delivered in electronic form, shall be accepted in any judicial or administrative proceedings arising out of or relating to these Terms and Conditions, the Privacy Policy and the Online Terms and Conditions of Sale, in the same manner and under the same conditions as other documents and commercial registers created and maintained in printed form. All rights not expressly waived in this document are reserved.
All agreements to which the present general terms and conditions apply are governed by Belgian law. The courts of the registered office of KRC Genk VZW have exclusive jurisdiction for all disputes that may arise in connection with these general terms and conditions.
